Note publique d'information : Le législateur a reconnu a l'institution pénitentiaire la qualité de service public,
mais sans parvenir à en définir précisément les fonctions. Il en résulte une hiérarchisation
des priorités. Le droit applicable à l’activité pénitentiaire repose sur un impératif
unique : la sécurité. Le fait qu'il soit fonde sur cette mission essentielle n'est
pas critiquable en soi ; en revanche, le sens donne a cette notion l'est bien davantage.
Elle sert en effet trop souvent de prétexte pour permettre de déroger aux règles en
vigueur dans l'ensemble des services publics. Tout repose sur une conception révolue
de la sécurité qui cache mal une appréciation incertaine des exigences réelles de
l'institution carcérale et du traitement pénitentiaire. De ce fait le droit pénitentiaire
public se marginalise, plus par manque d'attention que par nécessité. Pour améliorer
cette discipline, il convient d'aborder la prison comme une administration. De cette
façon, il est possible d'accorder aux détenus le statut d'usager incarcéré et par
conséquent de définir les droits et les obligations à la charge de l'administration
et des détenus. Le rôle du juge administratif apparaît fondamental dans l’élaboration
du contenu effectif du droit applicable en prison. Suivant une evolution logique,
le juge en a fait un droit parfaitement intégré au droit administratif général, en
revenant progressivement sur la conception traditionnelle de la mission de sécurité.
La redéfinition de la notion de mesures d'ordre intérieur et de la notion de faute
lourde a permis de poser les premiers jalons d'un rééquilibrage des missions du service
public pénitentiaire. La prison devient un fournisseur de prestations pour les tiers
mais aussi pour les personnes qu'elle doit prendre en charge. C'est avec la notion
de garde (et non plus de surveillance) que l’équilibre si fragile qui caractérise
le droit administratif est finalement en voie d’être trouvé.
Note publique d'information : The legislator recognized the penitentiary institution as a government service, but
without succeeding in precisely defining its functions. This results in hierarchy
of priorities. The law applicable to the penitentiary activity is based on a single
premiss : security. The fact that it is based on this essential mission isn't open
to criticism in itself ; on the other hand, the meaning ascribed to this notion is
further more. Actually, it's too often used as a pretext to ignore the regulations
in force in the whole government services. Everything is based on a past conception
of security which hides badly a poor appreciation of the real requirements of the
prison and of the penitentiary treatment. For this reason, penitentiary public law
marginalizes itself, more by lack of attention than by necessity. To improve this
discipline, it's advisable to tackle the prison as a government service. In this way,
it's possible to grant the prisoners " the prison users status " and thus to define
the rights and duties of both the prison administration and the prisoners. The judicial
power's function seems fundamental in establishing an effective set of laws applicable
in prison. By following a logical progression, the judge made it become a kind of
law which is perfectly integrated into the general administration law, by coming back
to the traditional concept of the security function. The new definition of the concepts
of " mesure d'ordre intérieur " and the concept of serious offense have made it possible
to take the first foundations to restore the balance of objectives to the penitentiary
government service. Prison is becoming a " service provider " for third-parties and
also for the people it takes charge of it's with the concept of custody (and not anymore
with the guarding concept) that the administrative law characteristic balance is finally
on track to be found.
